Jussie Smollett CUT From Broadway Musical, Prosecutor Kim Foxx Calls Him A 'Washed Up Celeb' & Goes In On R.Kelly Too

Jussie Smollett is currently living it up in Hawaii (smoking mysterious cigarettes) with his family. You know, taking a break from all of the drama following his "hate crime" fiasco. He's currently being sued by the City of Chicago for $130,000 for the extra hours put into investigating what police say was a staged attack. 

While he's still set to star on "Empire" (according to his co-host Taraji P. Henson), the actor has reportedly been cut for a leading role in Broadway's revival of Richard Greenberg's Tony-winning play, "Take Me Out."

The "Empire" star was in the running to play Darren Lemming, a mixed-race baseball star who comes out as gay. But, not anymore! A source spilled the beans to Deadline, revealing Jussie read for the lead role in January, before the alleged hate crime. No casting decision has been made about the lead role, but Jussie is out.

While Smollett is no longer in the picture, his casting apparently never proceeded to anything firm before the January 29 incident in Chicago that police say was a hate crime hoax perpetrated by Smollett for career advancement and attention.

"Take Me Out" will be directed by Scott Ellis as part of Second Stage’s 2019-20 season. Previews for the play are set to begin March 31, 2020, with opening night on April 23rd.


Chicago prosecutor Kim Foxx called Jussie Smollett a "washed up celeb who lied to cops" in text messages that were released this week.

Cook County State’s Attorney Kim Foxx's office made public thousands of internal texts and emails on the Jussie Smollett case in response to public-records requests by the Tribune and other media outlets.

In text messages sent to Joseph Magats (the Cook County prosecutor who made the decision to drop all charges against Jussie Smollett) on the day their office announced 16 criminal counts against the "Empire" actor for allegedly lying to authorities, Kim described the 36-year-old as a "washed up celeb" after she recused herself from the case for being in contact with one of Jussie's family members.

“Sooo......I’m recused, but when people accuse us of overcharging cases...16 counts on a class 4 (felony) becomes exhibit A,” Foxx texted Magats on March 8th.

Foxx then compared Jussie's charges from her office to R. Kelly's, who has been indicted on 10 aggravated sexual abuse charges.

“Pedophile with 4 victims 10 counts. Washed up celeb who lied to cops, 16. On a case eligible for deferred prosecution I think it’s indicative of something we should be looking at generally,” she wrote. "Just because we can charge something doesn’t mean we should."


After the texts were made public, Foxx defended everything she said via a statement.

“After the indictment became public, I reached out to Joe to discuss reviewing office policies to assure consistencies in our charging and our use of appropriate charging authority,” Foxx said. “I was elected to bring criminal justice reform and that includes intentionality, consistency, and discretion. I will continue to uphold these guiding principles.”

Speaking of R. Kelly....

R. Kelly failed to make a child support payment, so he may be heading back to jail...AGAIN.

Sources tell TMZ the Grammy Award winner missed his last 2 months of child support payments to his ex-wife Drea Kelly. As you know, he's ordered to cough up over $20K/month in child support to his ex-wife.

Back in March, Kellz was thrown in jail for failing to pay back the minimum $161K of the more than $200K that he owes in back child support. That arrest came after he turned himself in on the sexual abuse charges. He pleaded not guilty to all of the charges.

The "I Believe I Can Fly" singer was released after someone footed the bill for him to be released. Since then, he has been begging the judge to reduce his payments because he claims he can't afford it.

According to reports, the judge said he would hear Kelly's arguments, but not until May 8th. In the meantime, he's still supposed to pay his previous child support payment.

Earlier this month, Kelly hopped on Instagram pleading with everyone to "take it easy" on him as he was headed to do a show in Illinois. He reportedly made $22,000. However, he still hasn't paid anything on his child support tab.

Now, he could be heading back to jail.
